The
Purchaser acknowledges and agrees with the Vendor that the Lot
forms part of a development which is intended to be established
as a modern and well designed residential subdivision. For the
protection of all Purchasers of Lots in this subdivision, the
Purchaser agrees to comply with the following conditions.
A.
Not to erect or locate on land any building other than a new dwellinghouse
or a pre-built dwelling that has not been previously lived in,
together with appurtenant buildings reasonably required for the
use and occupation of the property for residential purposes.
B.
Not to erect or suffer to be erected on the property any dwellinghouse
containing a floor area of less than 80 square metres exclusive
of roof overhangs, verandahs, decking, garaging and carports and
any accessory buildings.
C.
Not to permit or suffer the erection of any temporary building
or structure upon the land including a caravan except such as
may be used in conjunction with the construction of permanent
buildings and which will be removed from the land upon completion
of the work.
D.
Not to permit any buildings or associated works in the course
of construction to be left without substantial work being carried
out for a period conceding three months.
E.
Not to permit or suffer the said land to be occupied or used for
residential purposes unless the dwellinghouse or dwelling unit
on the property has been substantially completed in accordance
with the terms of this agreement and the buildings meet the requirements
of the appropriate Local Authority.
F.
Not to permit or suffer the storage or accumulation on the property
of any building materials other than in the course of construction
of a dwellinghouse and or any other accessory in compliance with
the provisions of this agreement.
G.
Not to permit or suffer any advertisements, sign or hoarding of
a Commercial nature to be erected on any part of the land without
the prior written consent of the Vendor.
H.
The covenants contained in this clause shall run with the land
and shall be incorporated in any Memorandum of Transfer to the
Purchaser executed pursuant to the agreement AND THE PURCHASER
DOTH HEREBY COVENANT with the Vendor that if the Purchaser shall
transfer, assign or otherwise dispose of his interest in the land
then he shall make transfer, assignment or disposition subject
to the provisions of this clause and shall procure from the transferee
or assignee a Deed of Covenants in favour of the Vendor whereby
such Purchaser or assignee undertakes to fulfill the Purchaser’s
obligations under this clause.
I.
That the vendor has relaxed the restrictive covenants
in respect of Lot 13 to permit a restaurant/café activity
to be carried on from that Lot.
